Pui apartamentul pe un site, prime\u0219ti telefoane, faci c\u00e2teva vizite, semnezi un contract cu un \u0219ablon de internet \u0219i asta e tot. Dar asta func\u021bioneaz\u0103 doar at\u00e2ta timp c\u00e2t lucrurile merg bine. C\u00e2nd lucrurile merg prost, atunci descoperi c\u0103 o gre\u0219eal\u0103 la \u00eenceputul contractului te poate costa mii de euro.  <\/p><p>Contractul de leasing este unul dintre contractele cu cea mai imperativ\u0103 reglementare \u00een legisla\u021bia spaniol\u0103. Acest lucru \u00eenseamn\u0103 c\u0103 nu pute\u021bi conveni orice dori\u021bi, chiar dac\u0103 ambele p\u0103r\u021bi sunt de acord. Exist\u0103 multe clauze care, de\u0219i pot p\u0103rea rezonabile, sunt direct nule \u0219i neavenite. Iar dac\u0103 sunt prost redactate, chiria\u0219ul le va putea ignora, iar dumneavoastr\u0103 nu ve\u021bi putea face nimic \u00een acest sens.   <\/p><p>Iat\u0103 c\u00e2teva exemple reale:<\/p><ul><li>Dac\u0103 include\u021bi o clauz\u0103 care prevede c\u0103 chiria\u0219ul este responsabil pentru repara\u021biile minore, dar nu o redacta\u021bi \u00een conformitate cu legea, clauza respectiv\u0103 va fi nul\u0103 \u0219i va trebui s\u0103 pl\u0103ti\u021bi pentru toate repara\u021biile.<\/li><li>Dac\u0103 nu informa\u021bi corect chiria\u0219ul dac\u0103 proprietatea face obiectul controlului pre\u021burilor, a\u021bi putea fi amendat cu zeci de mii de euro.<\/li><li>Dac\u0103 nu notifica\u021bi \u00een mod corespunz\u0103tor chiria\u0219ul c\u0103 nu ve\u021bi re\u00eennoi contractul la expirarea acestuia, contractul va fi prelungit automat, iar chiria\u0219ul va putea continua s\u0103 v\u0103 ocupe proprietatea chiar dac\u0103 nu mai dori\u021bi s\u0103 i-o \u00eenchiria\u021bi.<\/li><li>\u00cen cazul \u00een care contractul nu prevede \u00een mod clar cine ce pl\u0103te\u0219te \u0219i ce se \u00eent\u00e2mpl\u0103 dac\u0103 nu este pl\u0103tit, nu ve\u021bi putea solicita anumite sume sau v\u0103 va costa mult timp \u0219i bani s\u0103 face\u021bi acest lucru.<\/li><\/ul><p>\u0218i acestea sunt doar c\u00e2teva exemple. A\u0219 putea continua pe pagini \u00eentregi. Acestea sunt proceduri reale, deschise \u00eempotriva proprietarilor care au ac\u021bionat cu bun\u0103 credin\u021b\u0103, dar au f\u0103cut erori tehnice.    <\/p><p>De exemplu:<\/p><ul><li>Proprietarii care nu au raportat corect pre\u021bul de \u00eenchiriere anterior.<\/li><li>Contracte f\u0103r\u0103 referin\u021b\u0103 cadastral\u0103 sau identificator al pre\u021bului de referin\u021b\u0103.<\/li><li>Cre\u0219teri ale veniturilor care nu sunt bine documentate.<\/li><li>Transferarea costurilor c\u0103tre chiria\u0219 f\u0103r\u0103 baz\u0103 legal\u0103.<\/li><li>Semnarea f\u0103r\u0103 \u00eenregistrarea corect\u0103 a locuin\u021bei ca fiind obi\u0219nuit\u0103 sau permanent\u0103.<\/li><\/ul><p>Acesta nu este un comportament r\u0103u inten\u021bionat. Sunt gre\u0219eli datorate ignoran\u021bei. Dar asta nu evit\u0103 o sanc\u021biune.
