Qualsevol assessor financer et dir\u00e0 que \u00e9s una de les millors maneres de tenir els teus diners invertits. \u00c9s una font d&#8217;ingressos recurrent, que et pot donar estabilitat i diversificaci\u00f3 al teu patrimoni. A m\u00e9s, si ho gestiones b\u00e9, pots aconseguir una rendibilitat superior a la que ofereixen la majoria de productes bancaris tradicionals.    <\/p><p>La mala not\u00edcia \u00e9s que, si est\u00e0s llogant un immoble, especialment si \u00e9s un habitatge, en aquest pa\u00eds, i molt especialment a Catalunya, hi tens en contra tota la legislaci\u00f3 i el sistema judicial. No \u00e9s una exageraci\u00f3. En els darrers anys, s&#8217;han aprovat una s\u00e8rie de normes que han restringit de manera severa els drets dels propietaris. El mercat d&#8217;arrendaments urbans ha deixat de ser un mercat lliure i cada cop est\u00e0 m\u00e9s intervingut. La llibertat del propietari \u00e9s pr\u00e0cticament inexistent.    <\/p><p>Hi ha normes draconianes, mal redactades i dif\u00edcils d&#8217;interpretar, que poden comportar-te multes de fins a 900.000\u20ac per incompliments que en molts casos ni tan sols sabies que existien. I s\u00ed, encara que sigui per error. En un entorn tan hostil, llogar sense assessorament legal \u00e9s assumir un risc que molt pocs propietaris es poden permetre.  <\/p><p>Hola, s\u00f3c \u00d3scar Vaello, advocat de Vaello Legal. Poses el pis a una web, reps trucades, fas unes visites, firmes un contracte amb una plantilla d&#8217;Internet, i ja est\u00e0. Per\u00f2 aix\u00f2 nom\u00e9s funciona mentre tot va b\u00e9. Quan les coses es torcen, \u00e9s quan descobreixes que un error a l&#8217;inici del contracte et pot costar milers d&#8217;euros.  <\/p><p>El contracte d\u201farrendament \u00e9s un dels contractes amb m\u00e9s regulaci\u00f3 imperativa del dret espanyol. Aix\u00f2 significa que no pots pactar el que vulguis, encara que les dues parts hi estigueu d&#8217;acord. Hi ha moltes cl\u00e0usules que, encara que semblin assenyades, s\u00f3n directament nul\u00b7les. I si estan mal redactades, l&#8217;inquil\u00ed les podr\u00e0 ignorar, i tu no hi podr\u00e0s fer res.   <\/p><p>Et dono alguns exemples reals:<\/p><ul><li>Si incloeu una cl\u00e0usula que diu que l&#8217;inquil\u00ed es fa c\u00e0rrec de les reparacions menors, per\u00f2 no la redactes d&#8217;acord amb el que diu la llei, aquesta cl\u00e0usula ser\u00e0 nul\u00b7la i haur\u00e0s de pagar tu totes les reparacions.<\/li><li>Si no informes correctament l&#8217;inquil\u00ed de si l&#8217;habitatge est\u00e0 subjecte al control de preus, et podrien sancionar amb desenes de milers d&#8217;euros.<\/li><li>Si no fas b\u00e9 la notificaci\u00f3 a l&#8217;inquil\u00ed que no renovar\u00e0s el contracte en v\u00e8ncer el termini, aquest es prorrogar\u00e0 autom\u00e0ticament, i podr\u00e0 continuar ocupant el teu habitatge encara que ja no el vulguis llogar.<\/li><li>Si el contracte no estableix amb claredat qui paga qu\u00e8, i qu\u00e8 passa si no es paga, no podr\u00e0s reclamar certes quantitats o et costar\u00e0 molt de temps i diners fer-ho.<\/li><\/ul><p>I aquests s\u00f3n nom\u00e9s alguns exemples. Podria seguir p\u00e0gines senceres. Les multes poden anar des de 3.000\u20ac fins a 900.000\u20ac. I s&#8217;estan imposant de deb\u00f2. No \u00e9s teoria, no \u00e9s amena\u00e7a buida. S\u00f3n procediments reals, que s&#8217;obren contra propietaris que van actuar amb bona fe, per\u00f2 que van cometre errors t\u00e8cnics.    <\/p><p>Per exemple:<\/p><ul><li>Propietaris que no van informar correctament sobre el preu anterior del lloguer.<\/li><li>Contractes sense refer\u00e8ncia cadastral o sense identificador de preu de refer\u00e8ncia.<\/li><li>Increments de renda que no estan ben justificats documentalment.<\/li><li>Repercussi\u00f3 de despeses a l&#8217;inquil\u00ed sense base legal.<\/li><li>Signar sense haver registrat correctament l&#8217;habitatge com a habitual o permanent.<\/li><\/ul><p>No es tracta de conductes malicioses. S\u00f3n errors per desconeixement. Per\u00f2 aix\u00f2 no evita la sanci\u00f3. I un cop arriba la multa, el mal ja est\u00e0 fet. Perqu\u00e8 encara que sembli que el sistema est\u00e0 en contra teu, encara hi ha marge per protegir els teus drets. Per\u00f2 cal con\u00e8ixer la llei.
